05. 1. This case had been posted for delivery of judgment on 12.09.2022 but inadvertently had not been listed in the weekly list published for the said date. It could not be listed under a special notice on 12.09.2022, as the Courts did not function on that day after 2.00 pm due to a Full Court Reference at 2.00 p.m. held on account of sad demise of Justice K.N. Singh, former Chief Justice of India. The case has therefore been listed for delivery of judgment today.

2. Judgment pronounced in separate sheets.

3. The TRP(C) is allowed. Civil Proceeding No 689 of 2017 (Prasanta Mallick @ Das vs. Manini Mallick) is transferred from the Court of the learned Judge, Family Court, Cuttack to the Court of the learned Judge, Family Court, Kendrapara. Records of the case in Civil Proceeding No.689 of 2017 (Prasanta Mallick @ Das vs. Manini Mallick) be transmitted to the Court of the learned Judge, Family Court, Kendrapara by 28.09.2022.

4. Copy of this order be communicated to the Court of the learned Judge, Family Court, Cuttack, by the registry forthwith for compliance.
