09. 1. The matter is taken up through hybrid mode.

2. Heard Mr. G.P. Dutta, learned counsel for the, insurer - Appellant, Mr. P.K. Nayak, learned counsel for claimant - Respondents and Mr. T. Mishra, learned counsel for the owner - Respondent No.3.

3. Mr. Dutta submits that the deficit court fee has already been paid on 24th September, 2022.

4. Office is to verify and accept.

5. It is seen from the impugned judgment that the owner though had appeared before the tribunal, but neither filed his WS nor adduced any evidence.

6. Being asked, Mr. Mishra submits that he will take instructions about his stand from the owner before the next date.

7. List the matter on 13th December, 2022. In the meantime Registry is directed to get copy of the LCRs in MAC Case No.42 of 2017 from the court of learned 3rd MACT, Talcher.
