08. 1. Heard Mr.Debasis Sarangi, learned counsel for the petitioner and Mr. P.K. Rout, learned Additional Standing Counsel for the State and M/s.Puspamitra Mohapatra, learned counsel for the opposite party No.2.

2. In course of argument, Mr. Sarangi, learned counsel for the petitioner relies on the judgment of the Apex Court in the case State of Karnataka Vrs. L. Muniswamy reported in AIR 1977 SC 1489. It is also submitted that the case is squarely covered by the judgment in the case of State of Haryana and ors. Vrs. Ch. Bhajan Lal and ors. reported in 1992 AIR 604.
