CORAM:
THE CHIEF JUSTICE
JUSTICE CHITTARANJAN DASH
ORDER
18.10.2022 Order No.
02. 1. The present appeal is directed against the judgment dated 1st November 2017, passed by the learned Single Judge rejecting the Appellant's W.P.(C) No.20296 of 2009, in which a prayer has been sought for a direction to the Respondents to award compensation to the Appellant on account of injury sustained due to electric shock.
2. The learned Single Judge has noted that the disputed questions of fact had to be adjudicated in proceedings in a Civil Court. Unless negligence of the Respondents was demonstrated, it would not be possible for the learned Single Judge to order compensation.
3. In the circumstances, the Court finds no error having been committed by the learned Single Judge which requires interference. The appeal is accordingly dismissed.
4. It will nevertheless be open to the Appellant to seek appropriate remedies in accordance with law.
(Dr. S. Muralidhar) Chief Justice
(Chittaranjan Dash) Judge S. Behera
