01. And I.A. No.12972 of 2022 This matter is taken up through hybrid mode.

2. Heard Mr. A. Kanungo, learned counsel appearing for the petitioner.

3. The petitioner has filed this writ petition seeking to quash the common order dated 10.05.2018 under Annexure- 22 passed by the Central Administrative Tribunal, Cuttack Bench, Cuttack in O.A. No.175 of 2018 and O.A. No.362 of 2018.

4. Mr. A. Kanungo, learned counsel appearing for the petitioner contended that though the petitioner filed aforesaid two separate O.As., but the Tribunal heard the matter together and passed a common order dated 10.05.2018. It is further contended that though the petitioner specifically pleaded in paragraph-5.3 of O.A. No. 175 of 2018 with regard to delegation of power and in paragraph-5.2 of O.A. No.362 of 2018 with regard to jurisdiction and in support of his contentions relied upon the judgments of the apex Court in Union of India v. B.V. Gopinath, 2014 (1) SCC 351 and State of Punjab v. V.K. Khana, AIR 2001 SC 343, the Tribunal has not considered the same and dismissed the O.As. Therefore, the petitioner has approached this Court.

5. Issue notice to the opposite parties both in main case and Interlocutory Application.

6. Let four extra copies of the writ petition be served within three days on Mr. P.K. Parhi, Deputy Solicitor General of India, as he appears for opposite parties no.1 to 4 to enable him obtain instructions or file counter affidavit.
