03. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).
2. This is an application under Section 5 of the Limitation Act for condoning the delay of 491 days in preferring the appeal against the ex-parte Judgment dated 18.01.2021 delivered in C.P. No.19 of 2020 by the Judge, Family Court, Phulbani.
3. Heard Mr. P.K. Das, learned counsel appearing for the applicant.
4. Issue notice as to why the delay as aforementioned shall not be condoned or any other order or orders shall not be passed as deem fit and proper in the circumstances of the case.
5. Notice is made returnable on 24.11.2022.
6. Steps for service of notice on the sole respondent be taken by the applicant by Registered Post with A.D. within a week from today.
