Learned Counsel for the Petitioner submits that the case of the Petitioner is squarely covered by the judgment of this Court in Chandra Nandi vs. State of Orissa, reported in 2021 (1) OLR 688, so also judgment of the apex Court in case of Prem Singh vs. State of Uttar Pradesh, reported in AIR 2019 SC 4390. He further submits that in view of the Provisions enshrined under Rule 18(III) of the Orissa Pension Rules, the Petitioner is entitled for Pension.

4. Learned Counsel for the State prays for some time to take instructions in the matter and file Counter.

5. List the matter in the week commencing from 28.11.2022.

6. Counter be filed in the meantime after serving copy of the same on the learned Counsel for the Petitioner, who may file Rejoinder, if any, in response to the said Counter within a week thereafter.
