5. 1. Heard learned counsel for the Parties.

2. There is no dispute that the relief sought for here is already

covered by judgment of this Court in disposal of O.J.C. No.12760

of 1998 disposed of on 19.1.2016. There is, however, statement at

the Bar that this judgment is under challenge in Division Bench in

Writ Appeal Nos.87/2016 & 398/2017 though pending but there is

no stay operating. For there is already disposal of similar matter,

this Court cannot have a different view. Thus while covering the

relief claimed here by the judgment of this Court in O.J.C.

No.12760 of 1998, this Court, keeping in view pendency of Writ

Appeal Nos.87/2016 & 398/2017 simply observes, there being no

obstruction in working out the judgment, grant of relief to the

Petitioner shall be however subject to the final outcome of Writ

Appeal Nos.87/2016 & 398/2017.

3. With the above observation, the Writ Petition stands disposed of.
