1. Learned counsel for the Appellant relies on the judgment of State Bank of India v. Mohammad Badruddin, AIROnLine 2019 SC 507 and submits that after the 42nd Amendment to the Constitution of India, the necessity of a second show cause notice at the stage of penalty has been dispensed with.
2. Issue notice to the Respondent both in the appeal as well as on the application for condonation of delay through registered/speed post with A.D. making it returnable before the next date, requisites for which shall be filed within three working days. The tracking report be placed on record before the next date.
3. List on 16th March, 2023.
