01. 2. Heard learned counsel for the parties.

3. The petitioner has filed this writ petition seeking direction to the opposite parties to allow the petitioner to avail the benefit of trained graduate scale of pay on attaining the age of 48 years.

4. Learned counsel for the petitioner contended that the case of the petitioner is covered by the judgment of this Court in the case of Radharani Samal v. State of Orissa, 2017 (I) ILR-CUT-546 and Akhaya Kumar Nayak v. State of Odisha and Ors. (W.P.(C) No. 5480 of 2021 disposed of on 04.08.2022). Therefore, this writ petition may be disposed of in the light of the aforesaid order.

5. Learned Standing Counsel for School and Mass Education Department does not dispute the position.

6. In the above view of the matter, this writ petition stands disposed of directing the opposite parties-authority to consider the case of the petitioner in the light of the judgment passed by this Court in the cases of Radharani Samal and Akhaya Kumar Nayak (supra), and pass appropriate order in accordance with law within a period of three months from the date of production of certified copy of this order.

Issue urgent certified copy as per rules.
