02. I.A. No.226 of 2021

1. This matter is taken up through hybrid mode.

2. It is submitted by the learned counsel for the appellants-petitioners that copy of the I.A. has been served on the learned Standing Counsel.

3. Learned Standing Counsel also submits that he has received the copy of the I.A.

4. It is submitted by the learned counsel for the appellants-petitioners that the reasons stated at Para-4 of the I.A. after the Judgment was pronounced on 03.12.2019, the petitioner was not intimated by the learned counsel and the pandemic set in February, 2020 that resulted in dislocation and the appellants will be prejudiced, if the delay is not condoned and the matter is RJ not heard on merits.

5. Having heard learned counsel for the appellants as well as learned counsel for the respondents, considering // 2 //

the grounds mentioned in the I.A. and the fact that since February, 2020, there was disruption due to pandemic and the appeal being statutory, the delay of 456 days in filing the appeal is condoned subject to the condition that the petitioner will deposit a sum of Rs.500/- in the Orissa High Court Bar Association Welfare Fund.

6. Accordingly, the I.A. is disposed of.
