01. 1. This matter is taken up through hybrid arrangement.

2. Heard.

3. In this writ petition, the petitioner has challenged the action of the opposite parties in not considering her representation regarding her contractual engagement as Physical Education Teacher (PET) in Upgraded Government High School pursuant to the Advertisement No.1/2010 published by the opposite party No.2- Director, Secondary Education, Odisha, Bhubaneswar for engagement of Contractual Teachers in Up-graded Government High Schools during 2010-11 and taking into account the judgment passed by the Odisha Administrative Tribunal (OAT) vide order dated 04.05.2015 in O.A. No.7(B) of 2011 confirmed by this Court vide order dated 27.11.2017 passed in W.P.(C) No.12955 of 2017.

4. Learned counsel for the petitioner submits that, though the petitioner's name figured in the merit list, but her name has been excluded in the list of appointment. However, similarly placed persons have already got appointment.

5. In view of such facts and circumstances, notice needs to be issued to the opposite parties.

6. Hence, issue notice to the opposite parties.

7. Mr. Biswajit Mohanty, learned Standing Counsel for the Department of School and Mass Education waives of notice on behalf of the opposite party Nos.1, 2 and 4 and Ms. Suman Pattanayak, learned Additional Government Advocate for the State waives of notice on behalf of the opposite party No.3. Required number of copies of the writ petition be served on each of them within three working days hence, who shall obtain instructions in the matter.

8. List this matter on 20th of April, 2022.
