02.02.2022 Order No. This matter is taken up through video conferencing mode.

2. Against rejection of claim for grant of benefit in terms of the judgment of this Court in the case of Ritanjali Giri @ Paul vrs. State of Odisha (School & M.E. Deptt.) & Ors : 2016(I) ILR 1162, vide order dated 21.10.2021 under Annexure-5, the petitioners have approached this Court by filing the present writ petition.

3. Learned counsel for the petitioners states that this question has already been decided by this Court in the case of Jagadish Singh Babu v. State of Odisha & Anr.(W.P.(C) No.29322 of 2020 disposed of on 11.08.2021). Therefore, this writ petition may be disposed of in terms of the said order.

4. Considering the contention raised by learned counsel for the petitioners and after going through the records, the order impugned under Annexure-5 dated 21.10.2021 is hereby quashed. The matter is remitted back to the authority to consider the case of the petitioner in the light of the order passed by this Court in the case of Jagadish Singh Babu (supra) as expeditiously as possible.

5. The writ petition is accordingly disposed of.

6. As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's notice no. 4798 dated 15th April, 2021, and Court's Office Order circulated vide Memo Nos.514 and 515 dated 7th January, 2022.
