01. 1. This matter is taken up through hybrid arrangement.

2. Heard.

3. In this case, the petitioners being trained graduates and trained intermediates by qualification had applied for the post of Sikshya Sahayak in respect of Nabrangpur, Kalahandi, Rayagada and Mayurbhanj districts pursuant to the advertisement dated 27.12.2016 published by the opposite parties during the academic year 2016-17. But the candidatures of the petitioners were rejected on the ground of overage, though they were placed in the select list.

4. The grievance of the petitioners, in this writ petition, is that since backlog vacancies for the post of Sikshya Sahayak are existing, they should have been engaged in terms of the decision of this Court rendered in W.A. No.701 of 2019.

5. Learned counsel for the petitioners contended that in the judgment passed by this Court in W.A. No.701 of 2019, similarly placed persons have been given liberty to approach the Government and their cases have been considered by the Government sympathetically.

6. But, instead of approaching the Government, the present petitioners have filed this writ petition on the self-same cause of action, which is nothing but abuse the process of law by the present petitioners.

7. At this stage, learned counsel for the petitioners wants to withdraw this writ petition with liberty to approach the appropriate authority for seeking appropriate reliefs.

8. Accordingly, this writ petition stands dismissed as withdrawn.

9. Urgent certified copy of this order be granted on proper application.
