06. 1. This matter is taken up through hybrid arrangement
(virtual / physical) mode.
2. The Appellant by filing this application under section
389 of the Cr.P.C. has prayed for suspension of execution
of sentence and his release on bail in T.R. Case No.06 of
2014 of the court of the learned Special Judge, Jharsuguda
pending disposal of this Appeal.
3. Heard learned Counsel for the Appellant and learned
Additional Government Advocate for the State.
4. Considering the submissions made, on going through
the impugned judgment as well as the depositions of the
victim P.W.3 together with that of the doctor P.W.11 and

also the relationship between the Appellant and the
victim, further keeping in view the surrounding
circumstances; at this stage, we do not find it to be a fit
case to direct for suspension of sentence and release of the
Appellant on bail in the aforesaid case pending disposal
of this appeal.
5. The I.A. is, accordingly, dismissed.
