Order No. The matter is taken up through hybrid mode.

2. Mr. S.K. Das, learned counsel for the petitioner submits that the case of the petitioner is covered by the judgment of this Court in W.A. No.509 of 2019 and the same is again confirmed in Supreme Court vide SLP (C) No.3555-3604 of 2021. The said orders appended to the writ petition as Annexures-2 and 3 respectively.

3. On the selfsame issue there appears the petitioner has made representation vide Annexure-4 is pending with the President, Board of Secondary Education, Odisha, Cuttack opposite party no.3. However, pendency of the representation on the self same issue, opposite party no.3 is directed to consider the grievance of the petitioner vide Annexure-4 and pass appropriate order granting

pensionary benefits up to 60 years of age taking into account the pleadings in the writ application as well as the judicial development made in Annexures-2 and

3. The entire exercise shall be concluded within a period of one and half month from the date of communication of this order.

4. With the above observation and direction, the writ petition is disposed of.

Issue urgent certified copy as per rules.
