2. Heard learned counsel for the parties.
3. The petitioner has filed this writ petition challenging the order dated 02.09.2021 issued by opposite party no.2 and prays for direction to the opposite parties to consider the case of the petitioner for the post of Peon under Rehabilitation Assistance Scheme 1990 as was in force on the date of application submitted by the petitioner on 04.01.2018.
4. Mr. S.N. Nayak, learned Additional Standing Counsel contended that such issue was under consideration before the division Bench of this Court in W.A. No. 367 of 2021 and the said Bench vide judgment dated 26.10.2021 allowed the writ appeal filed by the state holding that the consideration is to be made as per the new rule.
5. In view of the above, this writ petition is disposed of in terms of the order passed by the Division Bench in W.A. No. 367 of 2021 decided on 26.10.2021.
