2. The dispute is being raised qua imposition of the penalty under Clause 2(b)(i) of the agreement without issuance of any show-cause to that extent for imposition of penalty. In support of the same, learned counsel for the Petitioner cited a judgment in the case of Gorkha Security Services Vrs. Govt. (NCT of Delhi) reported in (2014) 9 Supreme Court Cases 105.

3. Issue notice for 25.01.2022.

4. Learned counsel for the State appears and waives notice for Opposite Parties.
