4. Learned Standing Counsel for School & Mass Education Department submits that this case is covered by the decision in the case of Niranjan Nayak v. State of Orissa reported in 2003 (2) OLR 321.

5. In view of the above, the writ petition is disposed of in terms of the decision in the case of Niranjan Nayak (supra) and the benefit as has been extended in the said judgment, be extended to the petitioner forthwith.
