This Criminal Revision has been filed challenging the conviction of the petitioner under Section 138 of the Negotiable Instruments Act, 1881 by the learned Special Judicial Magistrate, Berhampur by judgment dated 02.05.2017 in 1.C.C. Case No. 534 of 2015 (Trial No. 419 of 2016) sentencing her to undergo S.I. for one year and to pay compensation of Rs.12,25,000/- to the complainant as per Section 357 (3) of Cr.P.C. towards the cheque amount and cost of litigation. This conviction and sentence have been confirmed by the learned 1st Addl. Sessions Judge, Berhampur in Criminal Appeal No. 27 of 2017 on 22.07.2019.

Mr. G.N. Sahu, learned counsel for the petitioner states that while admitting the appeal, the learned appellate court had directed the petitioner to deposit a sum of Rs.2,45,000/- but he wants to take instruction if that amount has been deposited and is still lying in deposit.

Hence, list this matter on 08.12.2021 to enable learned counsel for the petitioner to obtain instruction and file an affidavit to that effect.
