01. 1. This matter is taken up through Hybrid Arrangement (Virtual/Physical Mode).

2. Heard.

3. The petitioner is stated to have filed a representation vide Annexure-3 before the Executive Engineer, Rural Works Division, Cuttack (Opposite Party No.4) claiming enhanced differential amount of minimum wages as per Government Notification and judgment of this Court in W.P.(C) No. 29271 of 2011 (Mahesh Prasad Mishra Vs. State of Orissa) disposed of on 17.11.2011. The representation vide Annexure-3 is stated to be still pending.

4. Regard being had to the fact and submission and the nature of relief sought for, the writ petition is disposed of directing the Executive Engineer, Rural Works Division, Cuttack

(Opposite Party No.4) to dispose of the representation of the petitioner vide Annexure-3 in accordance with law by passing a reasoned order, taking into consideration the dictum of this Court in the case of Mahesh Prasad Mishra vs. State of Orissa supra. The entire exercise be completed within a period of three months from the date of receipt of certified copy of this order.

5. It is made clear that, if the petitioner is otherwise entitled to the enhanced differential amount of minimum wages, the same be disbursed in his favour forthwith on disposal of the representation.

6. The petitioner is directed to supply the copy of the writ petition containing all the annexures along with certified copy of this order to Opposite Party No.4 for convenience and reference to Annexure-3.

7. The writ petition is accordingly disposed of.

8. Urgent certified copy of this order be granted as per rules.
