06. This matter is taken up through hybrid mode.

Mr. Gyana Ranjan Sahoo, learned counsel for the petitoner states that they have no instructions in the matter.

In this Criminal Revision, the petitioner-Jagannath Mohapatra has been convicted for commission of offence under Sections 279/304-A of I.P.C. and under Section 187 of the Motor Vehicles Act and to pay a fine of Rs.1000/-, in default, to undergo simple imprisonment for one month for the offence under Section 279 I.P.C., to pay a fine of Rs.2000/-, and in default of same to undergo simple imprisonment for two months for the offence under Section 304-A I.P.C. and further to pay a fine of Rs.250/-, in default of same to undergo simple imprisonment for seven days for the offence under Section 187 of the Motor Vehicles Act. The learned Magistrate further directed that if the fine amount is realized, out of the fine

amount, a sum of Rs.2000/- shall be paid to P.W.2 , Smt. Sushila Bauri, the wife of the deceased vide judgment and order dated 8.12.1999 in connection with G.R. CaseNo.38 of 1996 (T.R.No.43/1998). The said order was confirmed by the judgment and order dated 02.08.2003 passed by the learned Adhoc Addl. Sessions Judge, Gunupur in Criminal Appeal No.182 of 2002.

Mr. S.S.Pradhan, learned Addl. Government Advocate states that the brief has been misplaced in the office of the learned Advocate General for which he is unable to assist the Court.

List this matter on 18.11.2021 in order to enable the learned State counsel to collect a copy of the brief from the office.
