Heard Mr. D.N. Rath, learned counsel for the petitioner.
The petitioner has filed this writ petition seeking direction to the opposite parties for consideration of her application for appointment under rehabilitation assistance scheme pursuant to Annexure-4.
Mr. D.N. Rath, learned counsel for the petitioner contended that though the petitioner made application on 06.07.2018, her case has to be considered taking into consideration the Rules prevailing at the relevant point of time. But instead of considering her case, the authority directed the petitioner to make fresh application in accordance with present Rules called "Odisha Civil Service (Rehabilitation Assistance) Rules, 2020, which is not applicable to the petitioner. To substantiate his contention, he has relied upon the judgment of the apex Court in the case of Canara Bank and another Vs. M. Mahesh Kumar, AIR 2015 SC 2411.
Issue notice to the opposite parties.
Four extra copies of the writ petition be served on learned State Counsel appearing for opposite parties no.1 to 4 within three days enabling him to obtain instructions or file counter affidavit.
As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's notice no. 4798 dated 15th April, 2021.
