02. 28.01.2021 The matter is taken up through Video
Conferencing.
The Stamp Reporter has pointed out that the
provision of law in the cause title of the appeal memo
has not been correctly furnished.
Mr. Pravash Chandra Jena, learned counsel for the
appellant submits that since it is an appeal filed by the
informant challenging the order of acquittal of
respondent no.2, the correct provision of law should be
under section 372 of Cr.P.C. in place of section 378 of
Cr.P.C. and he undertakes to correct the same before the
Stamp Reporter by Monday (01.02.2021).
Learned counsel for the State shall obtain
instruction as to whether the State is going to challenge
the impugned judgment and order of acquittal before this
Court or not.
List this matter in the week commencing from 15th
February 2021.
