The petitioner has filed this writ petition seeking to quash the orders dated 18.10.2002 and 21.10.2002 under Annexure-9 and 10 respectively, and to issue direction to the opposite parties to approve the appointment of the petitioner against the post of Hindi Teacher or as a 3rd teacher either in the same school or in any other school where vacancies are available along with consequential benefits within a stipulated time.

In course of hearing, learned counsel for the petitioner states that the petitioner may be permitted to file a fresh representation before the opposite party no.1 highlighting the grievances and direction may be given to consider the same within a stipulated time taking into consideration the judgment of the Tribunal in the case of Santosh Kumar Rana v. State of Odisha and others (O.A. No.603 (C) of 2008 disposed of on 31.03.2011), to which learned State Counsel has no objection.

4. Considering the facts and circumstances of this case, but, however, without expressing any opinion on the merits of the case, this writ petition stands disposed of with the direction that in case the petitioner, with regard to the grievance made in this petition, files a fresh comprehensive representation before the opposite party no.1 within fifteen days hence, the same shall be considered by the said authority taking into consideration the judgment of Tribunal in the case of Santosh Kumar Rana v. State of Odisha and others (O.A. No.603 (C) of 2008 disposed of on 31.03.2011) and pass a reasoned and speaking order as expeditiously as possible, preferably within a period of three months from the date of receipt of such representation along with the certified copy of this order.

Issue urgent certified copy as per rules.
