Order No. 1. This matter is taken up through hybrid mode. 1 2. Heard learned counsel for the parties.

3. The petitioners have filed this writ petition seeking direction to the D.I. of Schools, Baliguda to consider the case of the petitioners separately for their promotion to the post of Headmasters in U.G.M.E./U.P./ Govt. M.E. Schools on the ratio of their acquiring B.Ed. qualifications against the post lying vacant prior to 12.08.1997 as per the Directors instructions to man the post as per prevailing law.

4. Mr. S. Jena, learned Standing Counsel for School and Mass Education Department contended that out of the four petitioners, three of them have already retired on attaining the age of superannuation, but claim has been made for grant of promotion pursuant to order passed by the Tribunal in Annexure-3. Thereby, the petitioners may approach the appropriate authority ventilating

their grievance, which shall be considered in accordance with law.

5. In view of the aforesaid limited grievance of the petitioners, this Court disposes of the writ petition granting liberty to the petitioners to file a fresh representation before the authority concerned ventilating their grievance within a period of two weeks. If such representation is filed within the time stipulated, the same shall be considered and disposed of by the said authority taking into consideration the judgment of the Tribunal in O.A. No. 609 of 1994, disposed of on 07.11.1998, vide Annexure-3, in accordance with law within a period of three months thereafter.

6. Issue urgent certified copy as per rules.
