Heard learned counsel for the petitioner.

The petitioner has filed this writ petition seeking direction to opposite party no.4 to allow 3rd RACP benefit in favour of the petitioner on completion of 30 years of service as on 01.01.2013 in the scale of pay of Rs.9,300/- to Rs.34,800/- with G.P. Rs.4600/- in accordance with Annexures-3 & 4 so also in the light of similar benefit as has been extended in the case of Forester/Forest Guard as per the order of the learned Tribunal vide Annexure-8 and order of implementation under Annexure-9 keeping in view the judgment in State of Odisha and another v. Bihari Lal and others (W.P.(C) No.2831 of 2016 disposed of on 27.06.2006).

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to opposite party no.4 vide Annexure-7 and the same may be directed to be disposed of within a stipulated time taking into consideration Annexures- 8 & 9.

Considering the limited grievance of the petitioner, this Court without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.4 to consider the representation filed by the petitioner vide Annexure-7 and pass appropriate order in accordance with law taking into consideration Annexures-8 & 9 within a period of three months from the date of production of authenticated/certified copy of this order.

Issue urgent certified copy as per rules.
