02. Against rejection of claim for compassionate appointment under Annexure-7 dated 14.12.2020, the petitioner has approached this Court by filing the present writ petition.
Learned counsel for the petitioner contended that the case of the petitioner should be considered on the basis of the judgment of the apex Court in the case of Canara Bank and another Vs. M. Mahesh Kumar, (2015) 7 SCC 412. But the said judgment has been overruled by a three Judge Bench of the apex Court in (2020) 7 SCC 617.
Issue notice to the opposite parties. Three extra copies of the writ petition be served on learned State Counsel appearing for opposite parties no.1 to 3 within three days enabling him to obtain instructions or file counter affidavit.
