  04.       1.      This matter is taken up through hybrid mode.

2. Having heard Mr. Milan Kanungo, learned Senior Advocate appearing for the Petitioner and Mr. P.P. Mohanty, learned Additional Government Advocate for the State, we are of the opinion that the ground for which the Petitioner's tender has been rejected after the same being accepted in a technical bid is not tenable in view of the reported judgment of this Court passed in the case of Sri Kaustuva Sahu -vrs.- State of Odisha & others: reported in 2017 (I) ILR - CUT-753.

3. However, we are not passing any interim order at present in view of the submissions made by Mr. P.P. Mohanty, learned Additional Government Advocate for the State that he

will take instructions in the matter and apprise the Court on the next date.

4. The learned Additional Government Advocate for the State shall intimate the Authorities about the pendency of the case, so that no order will be passed by the Authorities.

5. List this matter on 19th August, 2021.

6. Urgent certified copy of this order be granted on proper application.
