Heard learned counsel for the petitioner. The petitioner has filed this writ petition seeking direction to the opposite parties to grant revise pension and retiral benefits on the basis of his entire period of service from 16.02.1973 to 31.05.2009 by counting the intervening period of service from 01.05.1975 to 21.09.1982 as duty and for the purpose of pensionary benefits in view of the order dated 31.07.1982 vide Annexure-3 and in the light of the judgment of the apex Court in the case of Satbir Singh v. Chief of the Army Staff, New Delhi, (2013) 1 SCC 390 vide Annexure-9 as has been given to similarly situated persons.

In course of hearing, learned counsel for the petitioner states that highlighting the grievances, the petitioner has made representation to opposite party no.1 vide Annexure-8 and the same may be directed to be considered taking into consideration Annexure-9 within a stipulated time.

Considering the limited grievance of the petitioner, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing opposite party no.1 to consider the representation filed by the petitioner vide Annexure-8 and pass appropriate order in accordance with law taking into consideration Annexure-9 within a period of three months from the date of production of authenticated/certified copy this order. As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's notice no. 4798 dated 15th April, 2021.
