Heard Mr. A.K. Apat, learned counsel for the petitioner and Mr. B. Mohanty, learned Standing Counsel for the School and Mass Education Department.
The petitioner has filed this writ petition seeking direction to opposite parties no.2 to 4 to appoint him in a Class-III or Class-IV post befitting to his qualification under the Rehabilitation Assistance Scheme within a stipulated time.
Mr. A.K. Apat, learned counsel for the petitioner states that similar question has been considered by this Court in Dipti Ranjan Mishra v. State of Orissa and Others in W.P.(C) No.21648 of 2015 disposed of on 02.05.2017. Therefore, the case of the petitioner may be considered in the light of the aforesaid judgment.
Mr. B. Mohanty, learned Standing Counsel for the School and Mass Education Department states that since similar question has been decided by this Court in Dipti Ranjan Mishra (supra), direction may be issued to the authority to consider the case of the petitioner in the light of Dipti Ranjan Mishra (supra).
Considering the contentions raised by the learned counsel for the parties and without expressing any opinion on the merits of the case, this Court disposes of this writ petition directing opposite party no.2 to examine the applicability of the judgment passed in Dipti Ranjan Mishra v. State of Orissa and Others passed in W.P.(C) No.21648 of 2015 disposed of on 02.05.2017 to the present case, and if it is found that the case of the petitioner is squarely covered by the aforesaid decision, shall extend the benefit in accordance with law within a period of four months from the date of communication/production of an authenticated/certified copy of this order by the petitioner.
As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020, as modified by Court's notice no. 4798 dated 15th April, 2021.
