04. Mr. T. Patnaik, learned counsel for the petitioner submits that the case of the petitioner is covered by the judgment of this Court in Jogeswar Panda vs. The Chief General Manager (W.P.(C) No. 11424 of 2011, disposed of on 28.02.2019).

None appears for opposite party no.1. From the office note it appears that AD from opposite party no.1 has not back. However to give an opportunity to opposite party no.1, fresh steps be taken for issuance of notice to opposite party no.1 by registered post with A.D. within three days. Office shall send notice fixing a short returnable date.

As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a printout of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's Notice No. 4798 dated 15th April, 2021.
