02. 1. Heard Mr.S.K.Das, learned counsel appearing for the petitioner and Mr.D. Mohapatra, learned standing counsel appearing for the School & Mass Education Department.

2. Mr. Das, learned counsel for the petitioner submits that the case of the petitioner is covered by a judgment of this Court in W.A. No.509 of 2019 and the same is again confirmed in Supreme Court vide SLP(C) No. 3555-3604 of 2021. The said orders appended to the writ petition as Annexures-4 and 5 respectively.

3. On the self same issue there appears the petitioner has made representation vide Annexure-3 is pending with the President, Board of Secondary Education, Odisha, Cuttack, opposite party No.3. However, pendency of the representation on the self same issue, opposite party No.3 is directed to consider the grievance of the petitioner vide Annexure-3 and pass appropriate order granting pensionary benefits up to 60 years of age taking into account the

pleadings in the writ application as well as the judicial development made in Annexures-4 and 5. The entire exercise shall be concluded within a period of one and half month from the date of communication of this order along with copy of the writ petition by the petitioner.

4. With the above observation and direction the writ petition is disposed of.

5. As the restrictions due to resurgence of COVID-19 situation are continuing, learned counsel for the parties may utilize a print out of the order available in the High Court's website, at par with certified copy, subject to attestation by the concerned Advocate, in the manner prescribed vide Court's Notice No.4587, dated 25th March, 2020 as modified by Court's notice No.4798, dated 15th April, 2021.
