10. 08.04.2021:           The matter is taken up through video conferencing mode.
                          Heard learned counsel for the Petitioner and the learned
                  counsel for the State.
                          This is the second journey of the petitioner, who is in
                  custody in connection with Phiringia P.S. Case No.66 of 2019
                  corresponding to C.T. Case No.36 of 2019 on the file of learned
                  District and Sessions Judge-cum-Special Judge, Kandhamal,
                  Phulbani running for alleged commission of offence under section
                  20(b)(ii)(C)/25/29 of the NDPS Act, in filing this application under
                  section 439 Cr.P.C., has prayed for his release on bail.
                          Considering the submissions made and on going through
                  the materials as placed as also the order passed by this Court in
                  BLAPL No.7812 of 2019; further keeping in view the surrounding
                  circumstances including the period of detention of the Petitioner in
                  custody as well as the stage of the trial, while being inclined to
                  reconsider the prayer for grant of bail to the Petitioner; it is
                  directed that he Petitioner be released on bail in the aforesaid case
                  on such terms and conditions as deemed just and proper by the
                  court in seisin of the case with further conditions that (i) he will
                  appear in person before the court in seisin of the case on each and
                  every date of posting of the case till conclusion of the trial; (ii) will
                  appear before the I.O. of the case on every Monday in between
                  10.00 am to 2.00 pm till conclusion of the trial; will not leave the
                                // 2 //




       jurisdiction of the court till end of trial without prior permission;
       and will not indulge himself in any similar type of activity.
               Violation of any of the condition(s) shall entail
       cancellation of bail.
               The BLAPL is accordingly disposed.
               As the restrictions due to the COVID-19 situation are
       continuing, learned counsel for the parties may utilize a soft copy
       of this order/judgment available in the High Court's website or
       print out thereof at par with certified copy in the manner
       prescribed, vide Court's Notice No.4587 dated 25th March, 2020.
