The Petitioner, by filing this application, has prayed for a direction to the Opposite Parties to pay compensation of a sum of Rs.10,00,000/- to her husband for the permanent disability that he has incurred on account of electrocution and the expense he met for the medical treatment.
Learned counsel for the Petitioner submits that the husband of the Petitioner after the super cyclone AMPHAN was working as supervisor in the concerning restoration of electricity supply under Opposite Party No.5 and during that period, he sustained 70% burn injuries on his body on account of electrocution. It is his submission that despite several requests, the Opposite Parties are not paying any heed to compensate the Petitioner even though all the formalities as regards the reporting of the matter at the Police Station etc have been complied with.
Considering the submissions made and on going through the petition averments as also the documents annexed thereto, this writ application at this stage stands disposed of with the observation that it would be open for the Petitioner to move the appropriate forum as provided in law claiming compensation from the Opposite Parties on account of the injuries sustained by the husband of the Petitioner in course of his discharge of duty as supervisor under the Opposite Party No.5 being engaged in the work of restoration of electricity supply aftermath the super cyclone AMPHAN.
As the restrictions due to the COVID-19 situation are continuing, learned counsel for the parties may utilize a soft copy of // 2 //
this order/judgment available in the High Court's website or print out thereof at par with certified copy in the manner prescribed, vide Court's Notice No.4587 dated 25th March, 2020.
