This is the second journey of the petitioner, who is
apprehending his arrest in Patnagarh P.S. Case No.11 of 2018
corresponding to Special G.R. Case No.3 of 2018 pending on the
file of learned 1st Additional Sessions Judge-cum-Special Court
(POCSO Act), Bolangir, running for the alleged commission of
offence under section 376(2)(i)/452 of the IPC read with section 6
of POCSO Act, in filing this application under section 438, Cr.P.C.,
has prayed for his release on bail.
Heard learned counsel for the Petitioner and learned State
Counsel.
Considering the submissions made and on going through the
earlier order dated 24.04.2019 passed by this Court in BLAPL
No.1264 of 2018 as well as the materials on record as placed,
finding no such change in the circumstances; I am not inclined to
reconsider the prayer for grant of bail to the Petitioner.
\ The BLAPL is dismissed accordingly.
As the restrictions due to the COVID-19 situation are
continuing, learned counsel for the parties may utilize a soft copy of
this order/judgment available in the High Court's website or print
out thereof at par with certified copy in the manner prescribed, vide
Court's Notice No.4587 dated 25th March, 2020.
