JUDGMENT AND ORDER (ORAL)

1. The petitioner was initially appointed as Peon on 06.12.1988

in the scale of pay of Rs. 300-5-330-6-390-7-425/- p.m plus other

allowances as admissible under the rules, and he was confirmed against

the said post on 22.05.2002. It is the further case of the petitioner that

after confirmation, he was promoted to the post of Typist by order dated

23.12.2003.

2. Mr. N. Synkon, learned for the petitioner submits that in

spite of the materials on record which clearly reflected that the petitioner

has been confirmed in service, formal regularization however, has not

been accorded. He further submits that as the petitioner was confirmed

against a sanctioned post, there should be no impediment on the part of

the respondents to regularize the service of the petitioner.

3. Ms. S. Bhattacharjee, learned GA today has produced a

communication dated 10.08.2022, indicating the approval for

regularization of the petitioner, and his name appears at Sl. No. 5, of the

list appended thereto.

4. In this view of the matter, nothing survives for further

consideration before this Court and the same is closed with the direction

to the State respondents to complete the entire process preferably within

a period of 4(four) months from the date of receipt of a certified copy of

this order.

5. With the above noted directions, this writ petition stands

closed and is accordingly disposed of.
