30-01-2026 Heard Mr. Niraj B. Paonam, learned counsel appearing for the petitioner.
Issue notice, returnable by 26-02-2026.
Ms. Thanyomi Keishing, learned counsel assisting Mr. Lenin Hijam, learned AG entered appearance and accepts notice on behalf respondents No. 1 and 2 and Mr. Rustam, learned counsel assisting Mr. Kh. Tarunkumar, learned senior counsel entered appearance and accepts notice on behalf of respondent No. 3, hence no formal notice is called for.
Mr. Niraj B. Paonam, learned counsel made a prayer for passing an interim order for staying the operation of the order dated 04-12-2025 issued by the Registrar General, High Court of Manipur, by
WP(C) No. 66 of 2026 & anr. Contd.../-
which the petitioner has been ordered to retire from service w.e.f. 31-01-2026 on attaining the age of superannuation.
We have heard at length the submission advanced by the learned counsel appearing for the petitioner.
It has been submitted by the learned AG that in another writ petition being WP(C) No. 79 of 2025, the High Court Employees' Association, Manipur, in which the present petitioner is also a member, has already raised the same issue and sought for granting similar relief as in the present writ petition. It has also been submitted that in the said writ petition, the respondents have already filed their counter affidavits and in fact, exchange of pleadings between the parties in that writ petition has been completed and the said writ petition is in the stage of final hearing. The learned AG submitted that as the Government's stand has already been placed before this court in the said writ petition, no separate counter affidavit will be filed in connection with this writ petition and that the present writ petition can be heard together with the said writ petition. The learned AG further submitted that at the time of hearing of the present writ petition along with the aforesaid writ petition, the respondents will rely on the counter affidavit filed in the said writ petition.
Mr. Kh. Tarunkumar, learned senior counsel appearing for the respondent No. 3 also submitted that the respondent No. 3 had already filed counter affidavit in connection with WP(C) No. 79 of 2025 and that no separate counter affidavit will be filed in the present writ petition.

In the present writ petition, the petitioner has not even challenged the order dated 04-12-2025 by which she has been ordered to retire from service on attaining the age of superannuation and as such, this court is of the view that she cannot pray for staying the order which have not been even challenged in the present writ petition. We are also of the considered view that as the petitioner has been ordered to retire from service on attaining the age of superannuation as provided under the rules, we are not inclined to pass an interim order for staying the said order.
In view of the above, let these cases be listed for final hearing on 26-02-2026 along with WP(C) No. 79 of 2025
