These matters are taken up as supplementary item on the instructions
of Hon'ble the Chief Justice as Hon'ble Mr. Justice A. Bimol Singh has
recused these matters as one of his relatives is appearing on behalf of the
appellants.
Heard Mr. H. Prabirkumar, learned counsel for the appellants.
The appellants are the defendants in O.S. No. 63 of 2014 filed by the
respondent herein. The respondent No. 1/plaintiff prays for declaration as
the owner of homestead land under patta No. 78/614 (old), 200 (new)
covered by C.S. Dag No. 1247 measuring an area of 0.24 acre at Village
No. 78, Changangei, Imphal West. By the judgment and decree dated 05-
05-2025 in O.S. No. 63 of 2014 passed by the learned Civil Judge Senior
Division, Imphal West, the suit was decreed and the plaintiff was declared
as owner of the suit land and after acquisition of 0.0839, he is in still in
possession of 0.1561 acre of the suit land at village No. 78, Changangei,
Imphal West District, Patsoi Sub-Division. The appeal i.e. RFA No. 6 of 2025
filed by the appellants herein was dismissed by the learned District Judge,
Imphal West vide order dated 20-09-2025.
Mr. H. Prabirkumar, learned counsel for the appellants submits that
as per demarcation report 04-06-2015 conducted by the Sub-Deputy
Collector, Imphal West, Patsoi, the area found in the field is given as 0.279
acre and the respondent No. 1/plaintiff is in excess possession beyond the
recorded area of 0.24 acre and after acquisition, the remaining 0.1561 acre
is recorded in the decree.
Issue notice to the respondents.
Steps to be taken by the appellants by speed post and dasti in
addition.
Mr. H. Prabirkumar, learned counsel for the appellants, refers to
MC(RSA) No. 1 of 2026 praying for stay of the impugned order dated 20-09-
2025 passed by the learned District Judge, Imphal West in RFA No. 6 of
2025 during the pendency of the present appeal or in alternative,
maintaining status quo as on date till the next date.
The prayer for interim relief will be considered on the next date.
