[1] Heard Mr. M. Rendy, learned counsel for the petitioner and Mr. Th. Sukumar, learned Government Advocate for the State respondents. [2] By the present petition, the petitioner, who is a registered Contractor, has executed five tender works for the IFC Department (now Water Resources Department). It is stated that for the works executed during the period of 2013-2016, a sum of Rs. 12,89,865/- is pending payment. The petitioner has also submitted a representation in this regard. Since nothing concrete comes out, the petitioner approached this Court by way of the present petition. It is prayed that in the earlier occasion also, this Court passed orders directing the respondents-Department to verify the bills and upon such verification, necessary payment may be made to the Contractor. The prayer No. 2 is reproduced hereinbelow:--
"ii) To issue a Writ in the nature of Mandamus/Certiorari or any other appropriate writ/order/direction to release/pay/unpaid undisputed bills/amount of the humble petitioner for the works executed under the different work orders by the humble petitioner from 2013 to 2016 under the Irrigation and Flood Control Department, Manipur i.e. Rs. 12,89,865 (Twelve Lakh Eighty nine
thousand eight hundred sixty-five) of the completed work i.e. (i) Work Order No. EE/TPD-IV/4-6/AC/2013-14/1 dated 09-04-2013,
(ii) Work Order No. EE/TPD-IV/4-6/AC/2013-14 dated 15-11-
2013, (iii) Work Order No. EE/TPD-IV/4-6/AC/2013-14 dated 04- 03-2014, (iv) Work Order No. EE/TPD-IV/4-6/AC/2015-16/30 dated 27-02-2016, (v) Work Order No. EE/TPD-IV/4-6/AC/2015- 16/29 dated 27-02-2016 (AT ANNEXURE-A/1, A/2, A/3, A/4 & A/5) at the earliest as passed in the order dated 15-04-2024 passed in WP(C) No. 262 of 2024, order dated 22-12-2021 and 22-02-2021 passed in WP(C) No. 734 of 2021 and WP(C) No. 87 of 2021 respectively (ANNEXURE-A/8, A/9 & A/10), in the facts and circumstances of the present petition."
[3] Mr. M. Rendy, learned counsel for the petitioner, submits that the writ petition may be disposed of by directing the respondents to verify the works done by the petitioner and after proper verification, the respondents may be directed to release the necessary bills.
[4] Mr. Th. Sukumar, learned Government Advocate for the State respondents, submits that the Department may be given some time to verify the works and the undisputed bills as claimed by the petitioner. [5] Recording the submissions made at the Bar, the five works mentioned above be verified along with the undisputed bills as claimed by the petitioner. The Department may verify the five works mentioned above and the amount claimed by the petitioner. On such verification, the necessary amount may be released in terms of the seniority list of the works' completion dates as maintained by the Department. The process of verification shall be completed within a period of three months from the date of receipt of a copy of this order.
[6] With this observation, the writ petition is disposed of. [7] Interim order, if any, merges with the final order.
