[1] Heard Mr. N. Jotendro, learned sr. counsel assisted by Md. Syed Murtaza Ahmed, learned counsel on behalf of the petitioners.

[2] The petitioners are the absolute owners of the land covered under C.S. Dag Nos. and its offshoot dags, 92, 91, 88/466, 88/1059, 88/P & 88 under Patta Nos. 117/B, 117/C, 117/D, 115, 115/365, 118/278, 118/957, 118/A and 118 situated at Village No. 26- Wangkheirakpam Leikai under Porompat Tehsil, Imphal East District, Manipur.

[3] It is stated that 4 ft. area of the land belonging to the petitioners and land owners were acquired by the State Govt. through direct purchase. The learned sr. counsel for the petitioners alleged that the direct purchase is without consent of the petitioners and others. It is also stated that some of the land owners have accepted the compensation fixed by direct purchase and the petitioners herein have not accepted the amount fixed by the State Govt. as direct purchase. In terms of the notices for the eviction dated 23.06.2025 and 29.07.2025 issued by the Deputy Commissioner, Imphal East and Sub-Divisional Officer, Porompat that a plan for eviction of the encroachments upon the Govt. land was issued. It is stated that State Govt. has acquired 4 ft. area of land and drain has been constructed upon the same recently. It is also alleged that on 02.02.2026, officials of the respondents again came to execute eviction/demolition the homestead land of the petitioners and neighboring areas beyond the 4 ft. area already acquired by direct purchase. The petitioners submitted a joint representation dated 02.02.2026 to the (i) Secretary/Commissioner (Land Resources), Govt. of Manipur, (ii) The District Collector/Deputy Commissioner/District Magistrate, Imphal East District, Govt. of Manipur, (iii) the Sub-Divisional Officer, Porompat, Govt. of Manipur & (iv) The Sub Deputy Collector, Porompat, Manipur praying for proper demarcation of the land along with proper compensation under "The Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement (RFCTLARR) Act, 2013" and also to withhold the current eviction, acquisition, Earth work in the homestead land/shop site plots situated at new Patta Nos. 117/B, 117/C, 117/D, 115, 115/365, 118/278, 118/957, 118/A and 118 till proper verification is made. It is also prayed that till proper verification is made, the present eviction drive with respect to the petitioners be kept on hold concerning the patta land.

[4]                 Issue notice.

[5]                 Mr. Phungyo Zingkhei, learned Dy. GA assisting Mr. H. Devendra,

learned Dy. AG accept notice on behalf of all the respondents. Hence, service is complete on the respondents.

[6] The learned Dy. AG fairly submits that since the eviction is done upon the 4 ft. area acquired by direct purchase, the petitioners should not have any grievances and writ petition is not maintainable. If the proposed eviction is within the patta land of the petitioners, the same may be done after proper verification.

[7] Recording the submissions made at the bar, 2(two) week's time is granted to the respondents to file counter affidavit.

[8] It is clarified that the ongoing eviction within the 4 ft. area already acquired through direct purchase will not be affected by the pendency of the present petition. However, any eviction beyond 4 ft. area which falls within the homestead land of the petitioners' the patta land as mentioned above may be done after proper verification and by giving opportunity of being heard to the petitioners.

[9]              List these cases on 16.03.2026.

[10]             Furnish a copy of this order to the learned counsel appearing for

the parties in the course of the day through whatsapp or any other available mode.
