A Gift Deed dated 14.09.2021 registered as document No.684(V) on
the file of Sub-Registrar, Porompat, Imphal East District, Manipur( 'said Gift
Deed' for convenience) is the nucleus of the matter.
2. R3 (to be noted 'R3' denotes 'third respondent' and similar
abbreviations will be used for other respondents also) is the donor and the
revision petitioner is the donee and the subject matter of the gift deed is
'six parcels of land in Revenue Village No.004-Achanbigei, Tahsil Heingang
and Sub-Division: Porompat, Imphal East District, Manipur' ( 'said land' for
the sake of convenience) is the subject matter of the gift deed.
3. R3 has filed a suit in Original Suit No.22 of 2023 now pending
on the file Court of Civil Judge (Sr. Div.), Imphal East at Lamphelpat inter-
alia with a prayer seeking declaration that the said gift deed is illegal/not
binding on the plaintiff. Revision petitioner is defendant No.2 in this suit.
4. Defendant No.1 in the said suit is Shri Indra Dev Joshi, aged
about 92 years, S/o (late) Rudri Datt Joshi, resident of Koirengei Nepali
Basti, Achanbigei, P.O. Mantripukhri, P.S. Heingang, Imphal East District,
Manipur, at present C/o- Ms. Sandhya Joshi, D/o Shri ID Joshi, B-25, Vasant
Kunj Enclave, New Delhi-110070. This Court deems appropriate to add this
Shri Indra Dev Joshi suo-motto as respondent No.4 in the captioned revision
petition.
5. Pending suit, multiple orders have been made by different
revenue authorities qua said land necessitating captioned CRP is the say of
learned counsel of revision petitioner. Prima-facie case for admission made
out.
6. Issue notice to respondents.
7. Mr. W. Niranjit, learned Deputy Government Advocate for
State Government accepts notice for R1 & R2. Issue notice to R3 & R4,
returnable by 10.03.2026.
8. Dasti notice permitted.
9. As regard R3 & R4, learned counsel for revision petitioner is
also permitted to serve on learned counsel representing D1 & D2
respectively in the suit being Original Suit No.22 of 2023 on the file of Court
of Civil Judge(Sr. Div.), Imphal East at Lamphelpat clearly indicating the
next listing date.
10. Prayer in captioned M.C is as follows:
In view of the aforesaid facts and circumstances, it is therefore
prayed that your Lordship be pleased to:
a) In the interim the Hon'ble Court may be pleased to pass an
interim suspension or stay order of the impugned order dated
02.12.2024 passed by the Deputy Commissioner/District
Registrar, Imphal East District, being No.
DC(IE)9/10228/DAV/2022 dated 02/12/2024 and the
consequential order dated 02.12.2022 passed by the Sub-
Registrar, Porompat, Imphal East, being No. SR/IE(P)/NOT/24,
pending final disposal of the instant Civil Revision Petition.
b) Pass any appropriate orders or directions which this Hon'ble Court
may deem fit and proper to secure the ends of justice.
N.B. (Vide order dated 11/12/2025 passed in MC(CRP Art.227)
No.98 of 2025 dated 02/12/2024 is amended).
11. As prima-facie case has been made out and as balance of
convenience is in favour of grant of interim order as putting in motion the
impugned order/s can lead to complexities leading to irreparable legal
injury, there shall be an interim order as prayed for vide interim prayer (a)
till next listing.
12. As regards the interim prayer (b), this Court deems
appropriate to grant an order of interim stay of all further proceedings in
Original Suit No.22 of 2023 on the file of the Court of Civil Judge ( Sr. Div.),
Imphal East at Lamphelpat till next listing which shall be on 10.03.2026.
