B E F O R E HON'BLE MR. JUSTICE AHANTHEM BIMOL SINGH 09-05-2022 Heard Mr. K. Roshan, learned counsel appearing for the petitioner and Mr. Kh. Samarjit, learned ASG appearing for the respondents.

It is submitted by the counsel for the respondents that in compliance with the judgment and order dated 15-11-2021 passed by this court in WP(C) No. 706 of 2019 and WP(C) No. 707 of 2019, the respondents have issued an order dated 18-01-2022 effecting the new transfer and posting in respect of the petitioner and also issued an order dated 26-02-2022 with regard to the direction for payment of his back-wages due payable to the petitioner.

It has further been submitted that having been aggrieved by the aforesaid order dated 26-02-2022, the petitioner has challenged the said order by filing WP (C) No. 313 of 2022 before this court and accordingly, it has been submitted by the learned counsel that the contempt petition may be closed.

The learned counsel for the petitioner vehemently submitted that the respondents have not fully complied with the order passed by this court and that the order dated 26-02-2022 issued by the respondents in respect of payment of back-wages to the petitioner is not in compliance with the directions given by this court, however the learned counsel fairly submitted that they have challenged the said order by filing a writ petition before this court.

In view of the submission made above, this court is of the considered view that the respondents have complied with the orders of this court and the grievance of the petitioner against the compliance order can be pursued in the pending writ petition.

In view of the above, the present contempt petition stands closed.
