                                                          JUDGMENT

The Second Appeal is directed against the judgment and decree

passed in A.S.No.26 of 2014 dated 28.11.2014 on the file of the District

Court, Sivagangai, reversing the judgment and decree passed in O.S.No.

30 of 2010 dated 17.03.2014 on the file of the Subordinate Court,

Devakkottai.

2. When the matter is taken up for hearing today, the learned

counsel appearing for the appellant would submit that the sole appellant

died on 10.01.2024. He would further submit that he sent a letter to the

appellant and the same was returned with an endorsement 'deceased'.

3. Recording the submission made by the learned counsel

appearing for the appellant, this Second Appeal is dismissed as abated.

No costs.
