JUDGMENT

The writ order dated 25.11.2022, in W.P.No.26142 of 2017 is under
challenge in the present writ appeal.
2.The only issue to be considered is whether the appellant has obtained
necessary permission for extension of electricity service connection for first and
second floor construction made subsequently after completing the ground floor
construction.
3.It is not in dispute that the appellant has obtained permission for
electricity service connection for basement, ground floor and terrace. However,
the learned counsel for the appellant would submit that subsequently an
application was submitted seeking permission, but the respondents established
that permission was not granted to extend the electricity service connection to
the first and second floor. The provisions of the Act and Rules regarding

unauthorised usage of electricity connection was considered by the writ Court
with reference to Section 126 of the Electricity Act. This Court do not find any
infirmity in respect of the findings.
4.Thus, the writ appeal stands dismissed. No costs. Consequently,
connected miscellaneous petitions, if any, are also closed.
