                             Second Appeal is filed under Section 100 of Civil Procedure Code,

                   1908, against the judgment and decree dated 13.09.2011 passed in

                   A.S.No.22 of 2010 on the file of I Additional Subordinate Court, Salem,

                   confirming the judgment and decree dated 20.01.2010 passed in

                   O.S.No.67/2003 by the II Additional District Munsif Court, Salem by

                   allowing this Second Appeal.

                                                        JUDGMENT

This Second Appeal has been preferred challenging the judgment and

decree dated 13.09.2011 passed in A.S.No.22 of 2010 on the file of the I

Additional Subordinate Court, Salem.

2. When the matter is take up today, both side counsels are present.

The learned counsel for the appellant filed a memo stating that both the

parties have settled the dispute amicably outside the Court and they have

entered into an agreement dated 23.06.2025 and hence the Second Appeal

may be dismissed as withdrawn.

3. The learned counsel for the defendant has also made an

endorsement in the memo conceding the submission made by the learned

counsel for the appellant.

4. Recording the submission of both side counsels and taking into

consideration of the memo and the endorsement made, this Second Appeal is

allowed to be withdrawn as settled out of court. No costs. Connected
