Prayer: Writ Petition filed under Article 226 of the Constitution of India,
praying for issuance of Writ of Mandamus, directing the first respondent to
pass orders on the petitioner's Mercy Petition, dated 06.06.2025, in the
light of the Judgment passed by the learned Judicial Magistrate, Omalur,
Salem in C.C.No.208 of 2021, dated 16.04.2024, within the time frame
fixed by this Court.

ORDER
This Writ Petition has been filed seeking a direction to the first
respondent to pass orders on the petitioner's Mercy Petition, dated

06.06.2025, in the light of the Judgment passed by the learned Judicial
Magistrate, Omalur, Salem in C.C.No.208 of 2021, dated 16.04.2024,
within the time frame fixed by this Court.
2. Mr.Yogesh Kannadasan, learned Special Government Pleader
takes notice for the respondents.
3. By consent, this Writ Petition is taken up for final disposal today
at the admission stage itself.
4. The brief facts of the petitioner's case are that he is working as a
Fireman in the respondent Department and due to family dispute, FIR has
been registered against him and consequently, he has been suspended from
service and given punishment of postponement of increment for a period
of two years. However, after trial in C.C.No.208 of 2021, he has been
acquitted from charges. In this circumstances, he has filed an appeal as
against the punishment of postponement of increment and the same was
returned vide the proceedings dated 05.03.2025 stating that the appeal has
been filed beyond the limitation period of 60 days and a Mercy Petition
may be submitted to the 1st respondent through proper channel.

Accordingly, he has filed a Mercy Petition on 29.03.2025 and 06.06.2025
before the 1st respondent and the same has not been considered yet. Hence,
he has filed the present Writ petition seeking a direction to the first
respondent to consider the Mercy Petition dated 06.06.2025.
5. Considering the limited relief sought for in the Writ Petition,
without going into the merits of the case, this Court directs the first
respondent to consider the Mercy Petition of the petitioner dated
06.06.2024 and pass appropriate orders on merits and in accordance with
law, within a period of twelve weeks from the date of receipt of a copy of
this order. No costs.
6. With the above direction, this Writ petition stands disposed of.
No costs.
