It is not in dispute that the issue involved in this Appeal is covered by

the decision of the Hon’ble Supreme Court in Chief Engineer, T.N.E.B. vs.

Indraniammal dated 30.03.2010 made in C.A.No.2039 of 2006. Another

Division Bench of this Court in The Chairman-cum-Managing Director,

Tamil Nadu Generation and Distribution Corporation Ltd., vs. M.Seetha,

has also followed Chief Engineer, T.N.E.B. vs. Indraniammal and

dismissed the similar Appeal.

2. Hence the Writ Appeal fails and it is accordingly dismissed. There

shall be no order as to costs. Consequently, the connected miscellaneous

petition is closed.
