COMMON JUDGMENT
(Judgment of the Court was made by G.R.Swaminathan J.)
Heard both sides.
2.The writ petitioners presented documents of conveyance in
respect of the petition mentioned properties which are comprised in
T.S.No.1208/22/2A, Senaiyar Colony, Arapalayam Village,
Maninagaram, Madurai. The registering authority declined to register
the documents on the ground that the properties belong to Sri Vysyaraja
Mutt which has its headquarters in Karnataka. Refusal check slip was
put to challenge in writ proceedings. The learned single Judge vide order
dated 28.01.2022 dismissed the writ petitions. Challenging the same,
these Writ Appeals have been filed.
3.We are of the view that the learned single Judge was right in
dismissing the Writ Petitions and interference with the said order is not
warranted. However, the learned counsel appearing for the appellants
submitted that the appellants belong to middle class families and they
were misled into purchasing the lands in question. We made it clear that
it is for the appellants to enter into some reasonable understanding with

the Sri Vysyaraja Mutt. The case was adjourned on more than one
occasion for the said purpose.
4.Today, when the matter was taken up for hearing, the learned
counsel appearing for the sixth respondent Mutt submitted that if the
appellants agree that the sites on which the superstructures have been
built belong to the Mutt and they are willing to enter into a lease
agreement with the Mutt in respect of the land, the same would be
favourably considered on appropriate terms and conditions. As and when
the occupants want to transfer the superstructure to the third parties, they
must get “No Objection Certificate” from the Mutt. The learned counsel
appearing for the appellants are agreeable to the aforesaid terms and
conditions.
5.We make it clear that under no circumstance, the sites / land in
question will be the subject matter of any kind of conveyance or transfer
as it belongs to a religious institution. Since superstructures were built
by the appellants, in the event of the sixth respondent Mutt granting “No
Objection Certificate”, the superstructure alone can be the subject matter
of conveyance and as and when such documents are presented, the

registering authority will register the same provided he is satisfied that
“No Objection Certificate” in respect of the particular transaction had
been granted by the sixth respondent Mutt.
6.These Writ Appeals are disposed of accordingly. No costs.
