Today, when the matter was taken up for hearing,

Mr.V.Praveenkumar, learned counsel on record for appellant sought leave of

this Court to withdraw the captioned appeal but made a plea to preserve the

rights of the appellant to come back to this Court with a similar / same

appeal (after approaching the Hon'ble Commercial Division) if the need

arises, saying so, learned counsel has made an endorsement in the case file

and a scanned reproduction of the same is as follows:

2. In the light of the endorsement and reiteration of the same in

the hearing, captioned original side appeal is disposed of as closed /

withdrawn albeit with preservation of rights of the appellant to come back

to this Court with a similar/same appeal, if so advised and if it becomes

necessary, after approaching the Commercial Division. Leave to approach

the Commercial Division is also granted. Connected C.M.P. shall stand

closed. There shall be no order as to costs.
